Le droit et l’histoire
Trois ouvrages reviennent sur les questions du droit international et la question de la nature des trimes.
L’ancien juriste Bruno Cathala propose une analyse particulièrement fouillée et riche du droit international et des crimes contre l’Humanité. Il a lui-même été juge au Tribunal pénal international puis à la Cour d’assises de La Haye chargée de juger les crimes contre l’Humanité. Dans une vaste étude, il montre comment s’est élaborée la construction du droit qui n’avait pas pensé jusqu’au génocide arménien la question des crimes de masses. C’est avec les procès de Nuremberg puis de Tokyo que le droit international est réellement pensé. Il donne la légitimité des jugements et établit une première catégorisation : crime contre la paix, crime de guerre et crime contre l’humanité et a posteriori génocide. Non figé le droit international évolue, avec les malheurs du temps. Il souligne l’importance des acteurs du droit dans l’ouverture des enquêtes actuelles. De nouvelles catégorisations entrent en œuvre avec les massacres de masses commis par les Khmers rouges au Cambodge puis en Bosnie et au Rwanda. C’est ainsi que les viols de guerre ne sont reconnus comme un élément de la politique génocidaire alors qu’ils existent massivement lors des massacres de Nankin par les Japonais en 1937 que depuis les crimes de masse commis en ex-Yougoslavie et surtout au Rwanda. Touffu, mais très clairement exposé, il permet de saisir les mécanismes du droit international.
C’est en partie grâce à ses jugements au Rwanda que Juliette Bour a pu analyser la politique criminelle des Hutus contre les Tutsis. Son ouvrage montre que l’ensemble de la société hutue a été impliquée dans les crimes commis. Elle étudie les cas des violences commises par des femmes à travers notamment les comptes rendus des Gacaca et le Tribunal pénal internationale pour le Rwanda soulignant que la violence répond à un enchaînement et à une logique génocidaire. Tout en se penchant sur les logiques de défense des bourreaux, elle montre que la participation au génocide répond à des stratégies pour accéder au pouvoir et aux responsabilités. Le déchaînement de violence participe de cette volonté de reconnaissance dans une société particulièrement genrée et patriarcale. Enfin, elles soulignent comment ses bourreaux, comme toujours cherchent à réécrire l’histoire afin de se dédouaner de leur responsabilité d’une part et à réécrire l’histoire en la niant d’autre part.
Enfin, Rémi Rouméas souligne indirectement les apories du droit en analysant à un autre niveau comment les juristes et la société construisent les normes et les hiérarchies juridiques. Les catégorisations criminelles ont évolué. L’atteinte au bien a longtemps été considérée comme le crime le plus grave depuis deux décennies, les violences faites aux personnes. Sur les bases d’une enquête sociologique, il souligne que les professionnels de la Justice avocats comme magistrats intègrent ces normes pour en faire une morale naturelle qui finit par elle-même être acceptée par les victimes.
